29. h August, 2014. PRESENT HON'BLE Dr. JUSTICE VINEET KOTHARI Appearance: Mr. Jai Prakash Meena, petitioner present-in-person. -- BY THE COURT:

1. The lawyers are observing strike which is contrary to various Supreme Court decisions. Name of Mr. Manoj Purohit, counsel for the petitioner, is shown in the cause list.

2. Heard the petitioner, who is present in person.

3. The petitioner, who is working as Junior Technical Assistant (JTA) on contractual basis in Gram Panchayat Makrana. He was transferred twice-over within a month and by the impugned order (Annex.4) dated 12.08.2011, he has been transferred from Parbatsar to Makrana on account of administrative exigency. The petitioner has assailed his frequent transfers viz. twice over within a month. The petitioner has also filed a representation on 16.08.2014 (Annex.5) before the District S.B. CIVIL WRIT PETITION No.6060/2014. Jai Prakash Meena Vs. State of Rajasthan & Ors. Order dated 29/08/2014 2/2 Collector, Nagaur, who is Coordinator of the M-NREGA scheme, under which the petitioner has been employed on contract basis, and without awaiting of the decision of his representation, the petitioner has filed the present writ petition in this Court on 28.08.2014.

4. Having regard to the submissions made by the petitioner, and upon perusal of the averments made in the writ petition, the present writ petition is considered to be premature. It is for the petition to approach the learned District Collector, Nagaur, for passing appropriate orders in the matter on his representation.

The present writ petition is, accordingly, disposed of with liberty and direction to the petitioner to pursue his pending representation dated 16.08.2014 before the learned District Collector, Nagaur, and the District Collector, Nagaur, is expected in law law to decide the said representation, preferably after giving an opportunity of hearing to the petitioner. The petitioner in the first instance may appear before the learned District Collector, Nagaur, along-with copy of this order, on 03.09.2014 and the learned District Collector, is expected to decide the same within a period of fifteen days from that date.
