This order will dispose of four appeals bearing RFA Nos.198 to 200 of 1998 and 179 of 1999, as common questions of law and facts are involved therein.

However, the facts have been extracted from RFA No.198 of 1998.

The State of Punjab is in appeal before this Court against the award passed by learned court below seeking reduction of the amount awarded to the respondents on account of acquisition of land.

Brief facts of the case are that vide notification dated 2.12.1992 issued under Section 4 of the Land Acquisition Act, 1894 ( for short “the Act”.).land situated in the area of village Jugial, Tehsil Pathankot and District Gurdaspur was acquired by the State of Punjab for construction of Shahpur Kandi Hydel Channel from RD01138 mtrs of Shahpur Kandi Dam Project.

The same was followed by notification dated 3.5.1993 published on 14.5.1993 issued under Section 6 of the Act.

The Land Acquisition Collector (for short “the Collector”.) vide its award assessed the market value of the acquired land @ ` 15,000/- per acre.
