Petition filed under Section 439 Cr.P.C. The petitioners are accused Nos.2, 3, 5 & 6 in crime No.866/2014 of Taliparamba Police Station, which has been registered for the offences under Sections 143, 147, 148, 307, 324, 452 r/w. Section 149 IPC.
2. It is alleged that on account of political enmity at about 10.45 in the night on 25.06.2014 the petitioners, who are workers of CPI(M) attacked the first informant and others with the swords, iron rods and sticks causing them serious injuries. Their attempt was to murder the victims.
3. It is submitted by the learned counsel for the petitioners that the weapons have been recovered and the investigation is almost complete and the petitioners may be released on bail.
4. Heard the learned counsel for the petitioners and the learned Public Prosecutor. B.A. No.5564 of 2014 -2- 5. It is submitted by the learned Public Prosecutor that some of the weapons have already been recovered. The petitioners have been in custody since 26.06.2014. It appears that their further detention is not necessary for completion of the investigation. In the result, this Bail Application is allowed with the following conditions:
1. The petitioners shall be released on bail on their executing a bond for Rs.50,000/- (Rupees fifty thousand only ) each with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned. 2) The petitioners shall appear before the Investigating Officer between 10.30 a.m. and 11 30. a.m. on every Friday for 3 months; or till the final report is filed, whichever is earlier. 3) The petitioners shall not enter the territorial limits of the Taliparamba Police Station except for complying with the directions in this order. B.A. No.5564 of 2014 -3- 4) They shall not threaten or attempt to influence the witnesses or intimidate them.
