MANMOHAN, J: (Oral) 1. In a writ petition filed by Punjab Wrestling Association being W.P.(C) 2932/2013, this Court with consent of parties, had directed fresh election of the Executive Council of Punjab Wrestling Association on 25 th May, 2014 under the supervision of retired Mr. Justice S.N. Dhingra.

2. Today, with consent of parties, the Expulsion Resolution dated 23 rd April, 2013 passed by the General Council of Wrestling Federation of India whereby the petitioner was expelled for six years is set aside.

3. Further, with consent of parties, Mr. Justice S.N. Dhingra, a retired Judge of this Court (Cell No.9871300027) is appointed as the Inquiry Officer to deal with the allegations already levelled against petitioner-Mr. Kartar Singh.

4. Mr. Justice S.N. Dhingra is directed to decide the said allegations and submit his report to the General Council of Wrestling Federation of India as expeditiously as possible preferably within a period of three months.

5. It is further clarified that Mr. Justice S.N. Dhingra would conduct an inquiry only on the basis of charges already levelled against the petitioner by Wrestling Federation of India.

6. Both the learned counsel further assure and undertake to this Court that the report of Mr. Justice S.N. Dhingra shall be accepted by them without demur and no challenge would be filed against the said report. It is directed that Wrestling Federation of India shall act and take action only in accordance with the report of Mr. Justice S.N. Dhingra. It is clarified that if Mr. Justice S.N. Dhingra finds the petitioner guilty, he shall be at liberty to recommend any punishment that he deems appropriate.

7. Keeping in view the aforesaid consent, petitioner is permitted to contest the elections of the Wrestling Federation of India. However, the result of the election shall be subject to the decision taken by Mr. Justice S.N. Dhingra.

8. With consent of parties, the fee of Mr. Justice Dhingra for conducting an inquiry is fixed at Rs.3,00,000/- which shall be jointly shared by both the parties in equal proportion.
