Bhagya Shree Sharma & ORS.versus State of Rajasthan & ORS.(S.B.Civil Writ Petition No.7692/2013) Date of order : : 23.04.2014 PRESENT HON'BLE Mr.JUSTICE GOPAL KRISHAN VYAS Mr.Gopal Acharya, for the petitioneRs.BY THE COURT:- In this writ petition, petitioners are claiming bonus marks for the experience certificate for appointment on the post of Education Assistant in pursuance of advertisement dated 30.05.2013.

On 04.07.2013 an interim order was passed by this Court in which following directions were issued :- “In the meanwhile, the respondents are directed to accept application forms of the petitioner/petitioners who are/is working or have/has worked with Lok Jumbish, Serve Shiksha Abhiyan, Angan Wari Scheme or Prerak in the Government Projects and also an employee who remained employed with recognized education institutions as defined under Rajasthan Non-Government Education Institution Act, 1989 provisionally.

The application forms of the petitioner/petitioners to be accepted off-line for the purpose of consideration for appointment to the post of Education Assistant.

It is clarified that acceptance of application forms pursuant to this order shall not create any substantive right or equity in favour of the petitioner/petitioners.”

Admittedly, the controveRs.with regard to bonus marks is pending before the Hon'ble Supreme Court, therefore, this writ petition is disposed of with expectation from the respondents that after deciding the controveRs.of bonus marks by the Hon'ble Supreme Court, the case of petitioners will be considered strictly in accordance with law for appointment on the post of Education Assistant.
