D.B.CIVIL WRIT (PAROLE) PETITION NO.1265/2014 Laxman Ram Meghwal Versus The State of Rajasthan & ORS.Date of Order :: 18.04.2014 PRESENT HON'BLE Mr.JUSTICE GOVIND MATHUR HON'BLE Mr.JUSTICE VIJAY BISHNOI Mr.J.D.Singh Bhati for the petitioner Mr.Shiv Kumar Vyas - Government Advocate BY THE COURT : The petitioner has preferred this petition for writ to have a direction for the respondents for grant of 30 days' regular parole as per the provisions of the Rajasthan Prisoners Release on Parole Rules, 1958 (for short, 'the Rules of 1958') to his son Ram Chandra Meghwal.
The case of the convict-prisoner was considered by the District Parole Advisory Committee in its meeting dated 15.01.2014 and parole was denied on the count that the victim and the convict-prisoner both are residents of the same village and there may be breach of peace and tranquility in the event of grant of parole.
[2].We have perused the details given in the report submitted by the District Probation -cum- Prison Welfare Officer, Bikaner, where he has made a recommendation for grant of parole.

In view of it, the apprehension made by the District Parole Advisory Committee is not well-founded.
In our opinion, the denial of the parole is not in consonance with the Rules of 1958.
Accordingly, the decision taken by the District Parole Advisory Committee to deny parole to the [3].convict-prisoner is declared bad.
The writ petition is allowed.
The respondents are directed to release convict-prisoner Ram Chandra Meghwal S/o Laxman Ram Meghwal to avail second regular parole for a period of 30 days, provided he furnishes two sureties of Rs.50,000/- each and a personal bond of the same amount to the satisfaction of the Superintendent, Central Jail, Bikaner.
The Superintendent, Central Jail, Bikaner while releasing the convict-prisoner on parole shall be at liberty to impose other adequate and reasonable conditions to ensure his return to the State custody after availing parole.
