The petitioner, an agriculturist, obtained 0.6070 hectares of land as per Ext.P1 patta dated 19.11.2003 issued under the Kerala Land Assignment (Regulation of Occupation of Forest Lands Prior to 01.01.1997) Special Rules, 1993. The validity of the aforesaid Rules was under challenge in O.P.No.14276 of 1993, which was dismissed by a Full Bench of this Court as per judgment delivered on 7.10.1999. The petitioner in O.P.No.14276 of 1993 thereupon moved the Apex Court by filing Civil Appeal No.2116 of 2000. It was during the pendency of the said appeal that Ext.P1 patta was issued with an endorsement that it will subject to the decision of the Apex Court. Civil Appeal No.2116 of 2000 was heard and dismissed by the Apex Court as per judgment delivered on 20.3.2009 in Nature Lovers Movement v. State of Kerala & Others [JT2009(5) SC127. In this writ petition the petitioner prays for an order directing the first respondent to strike off the endorsement in Ext.P1 to the effect that it is subject to the decision of the Supreme Court.
