ORDER

Appearance: Mr.P.Mitra, Adv.Ms.Piyali Mitra, Adv.Mr.Sounak Ghosh, Adv.The Court :- Probate of the Will was granted long ago on 17th April, 1994.
The executor and beneficiary was the elder son of the testatrix, Hemanta Kumar Mukherjee.
The Will had another beneficiary being Susnata Mukherjee the younger son.
Susnata died on 15th November, 1995.
The probate of the Will was granted by this Court, without any contest.
However, the executor allegedly did not succeed in completing administration of the estate by distributing the same to the beneficiaries.
This allegation is made in an application for revocation of the grant (GA No.72 of 2011) filed by the widow of late Susnata Mukherjee.
Hemanta Kumar Mukherjee died on 14th January, 2014.
In my opinion, there is no point in keeping these two applications pending.
The probate was uncontested.
The application for revocation of the grant was made solely on the ground that the executor had allegedly not completed administration of the estate.
According to Mr.Ghosh, the executor has filed the inventory and accounts in this Court.
I think Joint Administrators should be appointed by this Court to complete its administration in terms of the Will, if not completed earlier, within six months from date.
If administration has been completed, the Joint Administrators will record so in a report.
The report recording completion of administration or confirmation that administration stands completed should be filed in this Court by 29th September, 2014.
Mr.Nilendu Bhattacharya, Advocate and a member of Bar Library Club and Mr.Tapan Coomer Dey, Advocate, 1st floor, Room No.17 of 7 Old Post Office Street, Kolkata 700 001 are appointed as Joint Administrators at a consolidated remuneration of Rs.20,000/- each to be paid by Mr.Ghosh’s client and the widow of late Susnata Mukherjee in equal shares.
The applications GA No.2596 of 2013 and GA No.72 of 2011 are disposed of by this order.
Urgent certified photocopy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
