Petitioner is accused in Crime No. 8 of 2010 of the Kottarakkara Excise Range office for the offences punishable under Secs.8(1) and (2) of the Abkari Act for alleged possession and transportation of 5 liters of arrack in a scooter on 25.01.2010, is in custody since 24.01.2014 and seeks bail.

2. Learned Public Prosecutor has opposed the application. It is submitted that the petitioner is also involved in Crime Nos. 61 of 2009 and 6 of 2010 for offences of similar nature. The petitioner was not available since 21.11.2010.

3. Learned counsel submits that since registration of the crime, the petitioner got married and leading a peaceful life. The petitioner is not involved in any other offence. B.A No. 1405 of 2014 2 4. Having regard to the circumstances, I am inclined to grant bail but subject to stringent conditions to prevent recurrence of such incidents in future.
