Petitioner is accused in Crime No.22 of 2014 of the Pampa Police station for the offence punishable under Sec.55(i) of the Kerala Abkari Act for alleged possession of 3 litres of Indian Made Foreign Liquor on 13.01.2014, is in custody since then and seeks bail.
2. I have heard the learned counsel for the petitioner and the learned Public Prosecutor. It is revealed that the petitioner is not involved in any other case registered by the Pampa Police. But the learned Public Prosecutor has pointed out that the petitioner belongs to the State of Tamil Nadu and that if he released on bail he may not be available for trial.
3. Learned counsel has offered to produce at least one surety from and having landed property in the State of Kerala.
4. Having regard to the relevant circumstances, I am inclined to grant relief to the petitioner but, subject Bail Appl. No.726 of 2014 2 to conditions and accepting the offer made by the learned counsel for the petitioner. The application is allowed as under. Petitioner is granted bail in Crime No.22 of 2014 of the Pampa Police station and shall be released (if not required to be detained otherwise) on his executing bond for Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for the like sum each to the satisfaction of the learned magistrate and subject to the following conditions: (a) One of the sureties, as offered by the learned counsel shall be from and having landed property in the State of Kerala. (b) Petitioner shall report to the officer investigating the case on every Saturday between 10.00 am and 12.00 pm until otherwise ordered by the jurisdictional magistrate until committal if any and thereafter by the learned Principal Sessions Judge concerned. (c) Petitioner shall report to the investigating officer as and when required for Bail Appl. No.726 of 2014 3 interrogation. (d) Petitioner shall not until otherwise ordered and except with the permission of the learned magistrate/Principal Sessions Judge as aforesaid, leave the State of Kerala. (e) Petitioner shall not get involved in any offence during the period of this bail. (f) Petitioner shall not intimidate or influence the witnesses. (g) In case any of condition nos.(b) to (f) is violated, it is open to the investigating officer to file application before the learned magistrate/ Principal Sessions Judge as aforesaid for cancellation of the bail granted hereby, as held in P.K.
