JUDGMENT

The petitioner has filed this Writ Petition aggrieved by the proposal to acquire a portion of his land for construction of the Mutholy-Bharanganam Highway. The road in front of the petitioner's property, according to him, is 6.5 meters wide. The same is proposed to be increased to a width of 16 meters. The proposal, if implemented, would result in demotion of his compound wall and denial of the means of access to his house from the road. His property is alleged to be at a height of 14 feet above the road level. Though the petitioner has submitted Ext.P9 representation to the 2nd respondent, he complains that, no orders are passed thereon till date.

2. The learned Special Government Pleader Sri C.S.Manilal submits on instructions that the final decision to be taken on the question of alignment is by the Chief Engineer (Roads & Bridges), PWD. He assures that Ext.P9 would be considered and necessary orders passed thereon, without further delay. W.P(c) No.31553 of 2011-T2In view of the above, this Writ Petition is disposed of directing the 2nd respondent to transmit Ext.P9 representation to the Chief Engineer (Roads & Bridges), PWD, and further directing the Chief Engineer to consider the said representation in accordance with law, after affording an opportunity of being heard to the petitioner also, and to pass appropriate orders thereon, as expeditiously as possible and at any rate, within a period of one month of the date of receipt of a copy of this judgment.
