------------------------------------ W.P.(C). No. 1220 of 2014 --------------------------------------------------- Dated this the 5th day of February, 2014 JUDGMENT

Aggrieved by the extension of the period of suspension approved by the educational authorities, the petitioner had preferred Ext.P33 revision petition under Rule 92 of Chapter XIVA KER, before the 1st respondent. Since the revision petition is not considered and disposed of, the petitioner is seeking appropriate direction. Inter alia, the petitioner had raised complaint about non- payment of subsistence allowance.

2. Learned Government Pleader on the basis of instructions submitted that, the 4th respondent had now issued a proceedings dated 28.01.2014 sanctioning subsistence allowance to the petitioner for the period of suspension. It is submitted that on the basis of the said proceedings the petitioner can claim payment of subsistence allowance on submitting bills through proper channel. W.P.(C). No. 1220 of 2014 -2- 3. Considering the factual situation this court is of the opinion that, an adjudication on merits is not warranted, because a statutory appeal is pending consideration and disposal before the 1st respondent. Hence the writ petition can be disposed of directing an early disposal of Ext.P33.

4. Therefore this writ petition is disposed of by directing the 1st respondent to consider and to pass appropriate orders on Ext.P33 revision petition, after affording an opportunity of personal hearing to the petitioner and other parties concerned, at the earliest possible, at any rate within a period of 3 months from the date of receipt of a copy of this judgment.
