JUDGMENT

Heard the Counsel for the petitioners and the Standing Counsel for the respondent.

2. The following are the details of the suit and the Court in which the same are pending. Sl. All the suits have been filed by the respondent bank seeking recovery of money disbursed by way of educational loan. The defence raised by the petitioners in the suit is that there is O.P.(C) No.290 of 2014 2 fraud in the disbursement of the loans. A common case is set up by the respondent bank in all the cases even though the loans had been advanced on the basis of different documents.

4. The trial in O.S No.456/2010 on the file of the Second Additional Sub Court, Ernakulam has just commenced. Interest of justice would be met by ordering transfer of all the other suits above mentioned to the Second Additional Sub Court, Ernakulam. The Second Additional Sub Court, Ernakulam shall have independent though simultaneous trial of all suits. This is to allay any apprehension of conflict of decisions in the suits of the same nature. I clarify that there shall not be any joint trial of the suits however in view of the separate and independent transactions.

5. The court below will endeavour to dispose of all the suits within a period of four months from today. The registry shall forward the copy of this judgment to the respective courts. Ext.P4 order refusing transfer of the suits for joint trial is modified accordingly. The Original Petition is disposed of. V.CHITAMBARESH JUDGE smm
