IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRR (F) No.173 of 2013 Date of decision: January 08, 2014 Pinki Petitioner Versus Smt.Parmila Devi and others Respondents CORAM: HON’BLE Mr.JUSTICE INDERJIT SINGH Present: Mr.Bhupeshwar Singh Jaswal, Advocate for the petitioner.
Mr.Vinod Bhardwaj, Advocate for the respondents.
--- INDERJIT SINGH, J.
Revision petitioner Pinki has filed this petition against Smt.Parmila Devi and others under Section 401 Cr.P.C.challenging the order dated 30.08.2013 passed by the court of District Judge, Family Court, Ambala vide which the petition stood allowed partially holding that petitioner No.1 (respondent No.1 in present case) is entitled to maintenance of ` 3000/- per month.
At the time of arguments, learned counsel for the petitioner argued only on one point that the petitioner has not married with Smt.Parmila Devi and no maintenance can be granted to her.
He further argued that in the present case there is no documentary evidence to prove that Parmila Devi is wife of the petitioner.
Gulati Vineet 2014.01.14 16:16 I attest to the accuracy and integrity of this document Chandigarh CRR (F) No.173 of 2013 -2- I have gone through the impugned order, the evidence produced by the petitioner as well as the cross-examination.
From the evidence produced by the applicant in that case and also from the cross-examination of the revision petitioner, the lower Court has reached to the conclusion that Parmila Devi was married with Pinki, the present revision petitioner.
The lower Court has relied upon the documents, photographs and the affidavits etc.The findings are given on the basis of evidence.
Learned counsel for the petitioner has not pointed out any illegality in the order.
It is a revision petition and in the revision petition, the Court is not to re- appreciate the evidence like an appeal.
Learned counsel for the revision petitioner has not shown anything that any material evidence has not been discussed or any evidence has not been appreciated as per law or any evidence, which is not a legal evidence, has been relied upon etc. There is nothing on the record to show that the order passed by the Family Court is illegal.
Therefore, from the above, I find that the learned Family Court gave findings regarding marriage between the parties on the basis of evidence produced before it and the order passed by learned Family Court is correct and as per law.
Resultantly, finding no merit in the present revision petition, the same is dismissed.
