The petitioner is the fifth accused in CC No. 2073/13 on the file of the Judicial First Class Magistrate Court-I, Chavakkad. The offences alleged are punishable under Sections 417, 418, 420 r/w 34 of IPC. The Crl.M.C is filed seeking to quash Annexure-A3 charge.

2. It is submitted that the petitioner is not the trustee of the Santhimadom Builders and that he was only the employee. It is also submitted that the petitioner has not received any amount from the de facto complainant and no document was executed by the petitioner in favour of the second respondent. It is contended that the second respondent has falsely implicated the petitioner as accused No. 5 without any materials.

3. On perusal of the records, this Court is not inclined to examine the case on merits at this stage. The Crl.M.C is disposed of directing the petitioner to file application for discharge at the appropriate stage, in the event of filing application as aforesaid, the learned Magistrate shall consider the matter and dispose of the same within a period of three months from the date of filing the application for discharge.
