Petitioner is the first accused, in Crime No.784 of 2013 of the Gandhinagar Police Station for the offences punishable under Sections 326 r/w Section 34 of the Indian Penal Code, apprehends arrest and has filed this application.

Learned Public Prosecutor has submitted that on 27-08-2013 at relevant time, there was an altercation between the second accused who is the brother of the petitioner and one Ameer due to political rivalry. The petitioner came there ridding a motor cycle and assaulted Ameer with a wooden reaper causing fracture of the nasal bone. The wooden reaper is recovered. The second accused was taken to custody and later released on bail.

3. Learned counsel submitted that the allegations are not true and that the petitioner only took the second accused to the hospital for treatment.

4. Since the wooden reaper is recovered and having regard to the nature of allegations, I am inclined to think that custodial interrogation of the petitioner is not required. Hence I am inclined to grant relief but subject to conditions.
