Petitioners are the accused Nos.1 to 4 in C.C.No.292/2012 on the files of the Judicial First Class Magistrate Court, Ottappalam. The 2nd respondent herein filed a private complaint before the Judicial First Class Magistrate Court, Ottappalam as C.M.P.No.365/2012. The court below forwarded the same under Section 156(3) of the Cr.P.C. to the Ottappalam Police. Crime No.220/2012 was registered alleging commission of offence punishable under Sections 341, 323, 384, 386, 468, 471, 506(i) read with Section 34 of IPC.
2. I have examined Annexure-A copy of CMP No.369/2012, Annexure B copy of FIR in Crime No.220/2012 of Ottappalam Police Station, Annexure C copy of the final report filed by the Sub Inspector of Police, Annexure D copy of the Plaint in O.S.No.892/2011, Sub Court, Palakkad, Cr.M.C.No. 4509 OF20132 Annexure E copy of the written statement filed by the defendant in O.S.52/2012, Sub Court Palakkad and Annexure F copy of the written statement filed by the defendant in O.S.No.52/2012, Sub Court, Palakkad. The materials perused primarily disclose offence under Sections 341, 323, 384, 386, 468, 471, 506(i) read with Section 34 of IPC. The Crl.M.C. is filed seeking to quash Crime No.220/2012 of Ottappalam Police Station pending as C.C.No.292/2012 of Judicial First Class Magistrate Court Ottappalam. In the facts and circumstances of the case, I am not inclined to allow the prayer. Accordingly, Crl.M.C. is dismissed without prejudice to the right of the petitioners to prefer a petition for discharge, if so advised.
