W.P.(C) NO.19933 OF 2012 8.

29.10.2013 Lawyers are abstaining from Court work.

Heard the father of the petitioner namely Sr.Kamal Lochan Mahanta in person.

This Writ Petition has been filed by the petitioner with a prayer to direct the Controller of Examination, Council of Higher Secondary Education, Odisha - opposite party no.1 to publish the results of +2 examination, 2012 of the petitioner.

On perusal of record, it appears that the petitioner appeared in the +2 examination, 2012 and Roll No.361KA071 was assigned to him.

In the Admit Card the name of the petitioner has been wrongly mentioned as “Rabindra Narayan Mohanta”.

instead of “Rabinarayan Mahanta”.Similarly Registration number of the petitioner has also been wrongly mentioned as “205167/10”.

instead of “10/205157”.Though the results of +2 examination, 2012 was published on 30.5.2012 but the results of the petitioner was No.published either in the internet or in the booklet.

Though the petitioner has filed a representation before opposite party no.1 on 01.6.2012 through his College praying to declare his result of +2 Science as a regular student but no action has been taken as yet.

A counter affidavit has been filed by opposite party no.3 stating therein that the problem has arisen because of some technical problem in communication between the Council and the College over internet.

It is further stated that the Council authorities have assured to publish the results of the petitioner at an early BP date.

Though learned counsel for Council of Higher Secondary Education has received a copy of this Writ Petition but no counter 2 affidavit has been filed on behalf of it.

Considering the above facts and circumstances, this Court disposes of this Writ Petition with a direction to opposite party no.1 to publish the results of the petitioner within a period of two weeks from the date of production of certified copy of this order.

Urgent Certified Copy of this order be granted on proper application.
