(Oral) In response to notice issued on 29.8.2013, Mr.Kirat Singh Sidhu, has placed on record the custody certificate, showing that a one year sentence was imposed upon the petitioner, for offences punishable under Sections 323, 324 read with Section 34 IPC, out of which, he has undergone an actual sentence of one month and 21 days.
As per the said custody certificate, no other case is pending against the petitioner.
In view of the above and the fact that he is a fiRs.time offender, and keeping in mind the nature of the offences, the petitioner shall be released on probation of good conduct for remaining part of his sentence.
He shall, consequently, be released on his furnishing a personal bond to the Harish Kumar 2013.10.10 11:35 I attest to the accuracy and integrity of this document CRR NO.2700 of 2013 -2- satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned, who shall also satisfy himself of the fact that the petitioner has a permanent residence within the jurisdiction of that Court.
If not, he would furnish two sureties, who are permanent residents within such jurisdiction.
Further, the report of the Probation Officer with regard to his conduct, be sent to this Court at the end of six months.
This petition is disposed of, subject to receipt of the report of his good conduct, after the said period of six months.
