Both the petitioners were appointed as Instructors in the Fabrication Sector under the Co.(Centre of Excellence) Scheme on a purely contractual basis in the year 2009/2010.
The present writ petition has been preferred praying for the issuance of directions to the respondent-authorities to permit them to continue in service uninterruptedly till such time regular recruitment is made against the post of Instructors and in the trade in which they are working.
Having heard learned counsel for the petitioners at length, I am of the considered view that the present writ petition Malik Sushama Rani 2013.09.19 15:44 I attest to the accuracy and integrity of this document CIVIL WRIT PETITION No.17952 of 2013 2 is pre-mature.
No material/document has been placed on record so as to substantiate the apprehension of the petitioners that while working on adhoc/contractual basis, their services would be dispensed with and they would be replaced by yet another contractual/adhoc arrangement.
It is always open for the respondent-Department/State to resort to the process of regular selection and appointment.
Accordingly, the present writ petition is dismissed being held to be not maintainable at this stage.
Suffice it to observe, that it shall be open for the petitioners to approach this Court afresh in the eventuality of their services being replaced by another set of adhoc/contractual employees.
Writ petition dismissed.
