Prayer in this petition is for grant of regular bail to the petitioner, Sucha Singh, who has been booked for having committed the offences punishable under Sections 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in a case arising out of FIR No.275, dated 07.12.2012, registered at Police Station, City, Batala.

Learned counsel contends that even if all the constituents of the capsules and other material alleged to have been recovered from the petitioner are taken at their face value then also, the same would attract the provisions of non-commercial quantity only.

Learned counsel for the State, on instructions from ASI Balwinder Singh, Polilce Station, City, Batala, very fairly concedes that the contraband alleged to have been recovered from the petitioner attracts the provisions of non-commercial quantity only.
