Heard Sri Ramawatar Sharma, learned counsel for the petitioners in A.B.A. No. 2273 of 2013 and Sri P.P.N. Roy, learned senior counsel for the petitioner in A.B.A. No. 2618 of 2013 and Sri Shekhar Sinha, learned Additional P.P. for the State in both the cases. It appears that the trucks of petitioners of A.B.A. No. 2273 of 2013 seized loaded with coal. It further appears that on demand the driver of the truck produced documents relating to coal loaded on their truck. Petitioner of A.B.A. No. 2618 of 2013 is purchaser of the coal from CCL and he heired truck bearing registration no. NL-02K- 1000 for transportation said coal. Learned Additional P.P., after going through the case diary, had fairly submitted that during investigation the documents produced by the driver were found genuine. -2- Considering the aforesaid facts and circumstances, I allow the anticipatory bail application and direct petitioners to surrender in the court below on or before 24.09.2013 and in the event of their surrender, the learned court below is directed to enlarge the petitioners, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Dhanbad, in connection with Govindpur (Barwadda) P.S. Case No. 138 of 2012 corresponding to G.R. No. 1375 of 2012, subject to the condition as laid down under section 438(2) of the Cr.P.C. (Prashant Kumar, J.) sunil/
