Deo For the opp. party/ respondents : xxx 18.09.2013 It appears that this appeal has been preferred under order XLIII, Rule 1(c) of the Code of Civil Procedure, against the order dated 3.7.2010 passed by learned Sub Judge, Deoghar, in Misc Case No. 06 of 2010, whereby he has refused to allow the petition filed by the appellants under Order IX, Rule 9 CPC. The office has indicated that in LA Reference brought before the Special Judge, Land Acquisition, the suit is valued at Rs.13,915/- and, therefore, in view of the amendment in the Bengal, Agra & Assam Civil Courts' (Jharkhand Amendment) Act, 2002, pecuniary jurisdiction to hear the appeal below Rs. 2,50,000/- ( rupees two lakhs and fifty thousand) has been given to the District Judge. In view of the above, this appeal is not maintainable before this Court and is, accordingly, dismissed. The memo of appeal may be handed over to the counsel for the appellants for presentation before the appropriate court having jurisdiction. Ambastha/- ( D.N.Upadhyay,J.)
