The petitioner has filed the present petition for issuing directions to the respondents for counting their previous service rendered in the Punjab State Handloom & Textile Development Corporation Limited (PUNTEX) towards his pensionary and other retiral benefits.
Counsel for the petitioner submits that the claim as raised in the present writ petition is clearly covered by a decision of Division Bench of this Court dated 24.03.2009 passed in LPA No.44 of 2006 titled as State of Punjab and others versus Subhash Chander Chadha and another (Annexure P-2).Counsel submits that even a legal notice dated 01.03.2013 (Annexure P-4) towards his claim has been preferred by the petitioner and the same is still pending consideration.
In the light of the averments made in the petition and the submissions raised by the counsel for the petitioner, I deem it appropriate to dispose of the writ petition with a direction to the respondent/authorities to CWP No.8136 o”
2. consider and decide the legal notice dated 01.03.2013 (Annexure P-4) in terms of passing a speaking order within a period of three months from the date of receipt of certified copy of this order.
Suffice it to observe that the authorities, while taking a decision in the matter, shall keep in mind the decision of this Court dated 24.03.2009 passed in LPA No.44 of 2006 titled as State of Punjab and others versus Subhash Chander Chadha and another (Annexure P-2).Decision so taken be conveyed to the petitioner forthwith.
The present petition is disposed of accordingly.
