13. h May, 2013 Harjit Singh ...Petitioner Versus State of Punjab ...Respondent CORAM: HON'BLE Mr.JUSTICE NARESH KUMAR SANGHI Present: Ms.Pooja Chopra, Advocate for Mr.Sarju Puri, Advocate for the petitioneRs.Mr.Piyush Bansal, DAG Punjab for the respondent Mr.G.P.S.Bal, Advocate for the complainant *** Naresh Kumar Sanghi, J.
Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Harjit Singh son of Gurbachan Dass, resident of Mohallan, District S.B.S.Nagar, who has been booked for having committed the offence punishable under Section 420, IPC, in a case arising out of FIR No.94, dated 30.05.2012, registered at Police Station, Goindwal Sahib, District Tarn Taran.
Learned counsel for the State on instructions from ASI Sanjeevan Singh of Police Station, Goindwal Sahib, District Tarn Taran very fairly concedes that in compliance of the interim order dated 10.04.2013, the petitioner has joined the investigation and no more required for any other purpose.
Learned counsel for the complainant submitted that the petitioner has duped the other persons in addition to the Criminal Misc.
not M-11384 of 2013 (O&M) 2 complainant, therefore, bail should not be granted to him.
I have heard counsel for the parties and perused the material available on record.
According to the State counsel no other case is pending against the petitioner.
He has already joined the investigation and no more required by the Investigating Agency for any other purpose.
The objection raised by counsel for the complainant that petitioner in involved in other cases also is not substantiated from the submissions made by counsel for the State.
Keeping in view the totality of the circumstances of the case, the present petition for grant of anticipatory bail to the petitioner-Harjit Singh is allowed and the order dated 10.04.2013, whereby ad-interim anticipatory bail was granted to the petitioner, is made absolute.
He shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2).Cr.P.C.(NARESH KUMAR SANGHI) May 13, 2013 JUDGE reena
