crr no.3366 of 2012 (o&m) 1 in the high court of punjab and haryana at chandigarh crr no.3366 of 2012 (o&m) decided on :11. 02-2013 tarsem kumar ....petitioner(s) versus state of punjab ....respondents coram:- hon'ble mr.justice mahesh grover present:- mr.ashok gupta, advocate for the petitioner ms.rajni gupta, addl. ag, punjab mahesh grover, j learned counsel for the petitioner at the very outset has stated that he does not press the case on merits and prays for some leniency to be shown to the petitioner who is facing the ordeal of criminal proceedings since 2006 and has a family to support which is not dire straits on account of his incarceration. he has prayed for reduction in the sentence. after hearing learned counsel for the petitioner and noticing the solitary prayer that has been made before this court and the fact that the petitioner has faced the ordeal of criminal proceedings since last 7 years and that he himself is not well advanced in years and has a family to support and also noticing the fact the petitioner is willing to compensate the family of the deceased persons somewhat in accordance with his own status and paying capacity, i deem it appropriate to dispose of the instant petition by reducing the sentence to that of already undergone and by enhancing the fine component to rs.1,05,000/- which shall be paid in equal proportion to the families of the deceased persons. the aforesaid amount shall be deposited before the learned crr no.3366 of 2012 (o&m) 2 trial court within a period of two months from today and shall be disbursed to the legal representatives of the deceased who died in the accident after due notice to them. failure to deposit the aforesaid amount within the stipulated period shall result in the revival of the sentence already imposed by the courts below and the petitioner will be required to undergo the remaining part of his sentence. disposed of in above terms.february 11, 2013 (mahesh grover) rekha judge

AG, Punjab MAHESH GROVER, J Learned counsel for the petitioner at the very outset has stated that he does not press the case on merits and prays for some leniency to be shown to the petitioner who is facing the ordeal of criminal proceedings since 2006 and has a family to support which is not dire straits on account of his incarceration.
