IN THE HIGH COURT AT CALCUTTA Civil Appellate Jurisdiction Original Side Present : The Hon’ble Justice Nishita Mhatre And The Hon’ble Justice Anindita Roy Saraswati 17.12.2012 GA 334.of 2010 APO 42.of 2010 CS 3 of 2005 Pran Kumar Bhattacharyya versus Sukumar Bhattacharyya & ORS.The Court :- The learned Advocate for the respondents has brought to our notice certain typographical errors in our order dated 10th December, 2012.
Unfortunately although the matter was fixed today with the consent of the learned Advocate for the appellant he was not present today at 10.30 A.M.when the matter was called on.
We, therefore, directed the learned Advocate for the respondents to inform him that we would consider the matter at 2 P.M.today.
However, Mr.Bhattacharyya, learned Advocate for the appellant is not present.
Since the changes are merely typographical errors we are of the view that the changes must be made.
Accordingly, the following changes should be carried out in our judgment and order dated 10th December, 2012.
“In the name of the advocates appearing for the parties the name of Mr.Indranil Nandi should be deleted as appearing for the respondent Nos.2(a) to 2(c).GA No.1493 of 2008 should read as GA No.1493 of 2009 in the entire order.
In paragraph 4 the date 27th August, 2008 on the second line should read as 27th August, 2010.
In paragraph 18 on the 8th line instead of words appellant no.1 the words defendant no.1 be inserted.
In paragraph 20 on the 10th line the date 24th February, 2011 should read as 2nd February, 2011.”
Let this order be incorporated in the judgment and order dated 10th December, 2012.
Urgent certified photostcopies of this order, if applied for, be given to the learned advocate for the parties upon compliance of all formalities.
