Taking note of the fact that the appellant has been convicted for offence under Section 379 of IPC and sentenced to undergo 1 year R.I.along with the fine amount of Rs.500/-, which amount has already been deposited by the appellant.

Considering the aforesaid, I.A.No.13955/2013 is allowed.

Appellant (Tulsi Pathak) is directed to be released on bail and operation of the sentence of conviction is directed to be suspended on his furnishing a personal bond in the sum of `15,000/- (Rs.Fifteen Thousand Only) with one surety of the like amount to the satisfaction of the trial court for his appearance before the Registry of this Court on 4th of September, 2013 and on such other dates as may be ordered.
