1 w.a.no.1258/2012 satish narayan datar state of m.p.& another 20.11.2012 shri praveen verma, counsel for appellant. shri vivek agrawal, ga for respondents. this appeal is directed against an order dated 1.10.2012 in writ petition no.16363/2012 by which a writ petition preferred by the appellant against his transfer order was dismissed. it was submitted by shri verma that the appellant is due to retire on 31.8.2013 and as per policy of the state government, he can be accommodated at a nearby place to satna where appellant has to ultimately settle. it was submitted that the place where appellant has been transferred is a distant place and the appellant may be adjusted at a nearby place. on raising such contention, shri agrawal, learned counsel for state submitted that appellant may submit a fresh representation for the aforesaid relief and in case any nearby place is vacant, respondents would consider to adjust the appellant at a nearby place. shri verma submitted that at government madhyamik shala, shersingh, there is a vacant post where appellant can be accommodated. as appellant has already joined at transferred place, appellant may submit a fresh representation for the aforesaid relief. in case any such representation is filed by the appellant within a period of 30 days from today, respondents shall consider and decide the representation for accommodating the appellant at a nearby place expeditiously as far as possible within a period of 30 days from the date of receipt of representation. with the aforesaid directions, this appeal is finally disposed of with no order as to costs. c.c.as per rules. This appeal is directed against an order dated 1.10.2012 in Writ Petition No.16363/2012 by which a writ petition preferred by the appellant against his transfer order was dismissed.

It was submitted by Shri Verma that the appellant is due to retire on 31.8.2013 and as per policy of the State Government, he can be accommodated at a nearby place to Satna where appellant has to ultimately settle.

It was submitted that the place where appellant has been transferred is a distant place and the appellant may be adjusted at a nearby place.
