He is heard on the question of admission.
Without challenging any specific order, the petitioner has filed this petition under Article 226 of the Constitution of India for issuing appropriate writ in the nature of mandamus directing the authorities of the respondents No.1 to 3 to issue him the Patta with respect of the disputed land by holding him to be the displaced person.
Such prayer is made by the petitioner on the basis of the circular dated 20.12.99 Annex.P/2 promulgated and circulated by the Rehabilitation Department of Madhya Pradesh.
Besides this, such prayer is also made on the basis of the provision of The Madhya Pradesh Nagariya Kshetro Ke Bhoomihin Vyakti (Pattadhriti Adhikaron Ka Pradan Kiya Jana) Adhiniyam,1984.
Petitioner's counsel instead to make any submission on merits of the matter has made his limited submission for issuing the appropriate direction to the respondent No.2 Collector to consider and decide his pending representation Annex.P/1 in accordance with the procedure prescribed under the law on some early date with time bound schedule.
The State counsel did not have any objection in disposing of this petition on the aforesaid limited prayer.
In view of the aforesaid, instead to admit or issue any notice to the other side, this petition is disposed of with a direction to the respondent No.2 Collector to decide the aforesaid representation Annex.P/1 in accordance with the prescribed procedure of law by speaking order within 90 days from the date of filing the certified copy of this order along with the copy of the petition with annexures in his office by the petitioner.
Petitioner's counsel is directed to submit such papers in the office of the Collector within 15 days from today.
