w.p.no.10699/2013 (naoserma khan versus general manager and others.26.06.2013 head shri u.k.sharma, learned senior counsel with shri p.n.tiwari, counsel for the petitioner on the question of admission and interim relief. the petitioner has filed this petition being aggrieved by order dated 10th/11th of june, 2013 passed by the respondent no.3 senior manager (mines) rajendra underground mines, budhar, district shahdol whereby the petitioner has been transferred from naogaon hunk line to rajendra underground mines. it is submitted that the impugned order is contrary to the policy and settlement arrived at between the management and the union. it is also stated that the petitioner has approached the competent authority by filing a representation against the impugned order of transfer on 17.06.2013 which has not been decided till date. in view of the aforesaid as there is an allegation regarding violation of the policy, without entering into the merits of the case or without commenting upon the entitlement of the petitioner, the petition filed by the petitioner is disposed of with a direction to the effect that in case the petitioner furnishes a copy of the order passed today along with a copy of the petition, the authority concerned shall consider and decide the representation dated 17.06.2013 of the petitioner expeditiously, in accordance with law. with the aforesaid directions, the petition filed by the petitioner stands disposed of. c.c.as per rules. W.P.No.10699/2013 (Naoserma Khan versus General Manager and otheRs.26.06.2013 Head Shri U.K.Sharma, learned senior counsel with Shri P.N.Tiwari, counsel for the petitioner on the question of admission and interim relief.

The petitioner has filed this petition being aggrieved by order dated 10th/11th of June, 2013 passed by the respondent No.3 Senior Manager (Mines) Rajendra Underground Mines, Budhar, District Shahdol whereby the petitioner has been transferred from Naogaon Hunk line to Rajendra Underground Mines.

It is submitted that the impugned order is contrary to the policy and settlement arrived at between the management and the Union.

It is also stated that the petitioner has approached the competent authority by filing a representation against the impugned order of transfer on 17.06.2013 which has not been decided till date.

In view of the aforesaid as there is an allegation regarding violation of the policy, without entering into the merits of the case or without commenting upon the entitlement of the petitioner, the petition filed by the petitioner is disposed of with a direction to the effect that in case the petitioner furnishes a copy of the order passed today along with a copy of the petition, the authority concerned shall consider and decide the representation dated 17.06.2013 of the petitioner expeditiously, in accordance with law.
