Full Judgment

Shri Rajesh Tiwari, learned Govt.

Adv.for the respondents on advance notice.

Petitioner is working as a Head Master in Govt.

Primary School Simarkala, Sankul High School Hathkuri, Block Pawai, District Panna.

An order was passed on 13.7.2012 transferring the petitioner to Govt.

Primary School Bisani Sankul Higher Secondary School Bisani.

Grievance of the petitioner is that petitioner is not being relieved for joining on the transferred post in pursuance to the order dated 13.7.2012 instead an order has been passed on 18.7.2012 whereby earlier order of transfer has been kept in abeyance.

Shri Rajesh Tiwari, learned counsel appearing for the respondents points out that certain mistakes have been committed in transferring the employees and the matter is pending with the competent authority and the competent authority has directed that all the transfer orders be kept in abeyance.

As it is routine administrative matter and as the petitioner has not joined on the transferred post, for the present no interference is called for.

Having heard learned counsel for the parties and on perusal of the record, it is seen that even though petitioner was transferred from one school to another in the same District but before the petitioner could be relieved and before his joining at the transferred place, finding certain administrative error being committed, the Competent authority has kept the order in abeyance.

That being so, for the present, no direction can be issued for permitting the petitioner to relieve and join at the transferred place as the matter is RAmesh kumar gupta versus state pending with the competent authority.

Accordingly, this petition is disposed of with a direction to the competent authority to decide with regard to continuation or otherwise of the petitioner in accordance to law by a speaking order within a reasonable time.

With the aforesaid, this petition stands disposed of.
