The petitioner - defendant has filed this petition under Article 227 of the Constitution of India being aggrieved by the order dated 24.4.2013, passed by the Civil Judge, Class-I, Pipariya in Co.No.14-A/ 11, (old No.3-A/11) filed by the petitioners against the respondents whereby application filed under Order 6, Rule 17 of CPC, (Ann.
