Sarvar Hussain versus GM, J.Cement and two otheRs.08.11.2012.

Shri A.K.Gupta for the petitioner.

Petitioner is working as a Heavy Vehicle Driver in the J.Cement Company Limited.

Grievance of the petitioner is that his services have been terminated in an illegal manner.

Respondent is a Private Limited Company.

It is not a ‘State’ within the meaning of Article 12 of the Constitution not is a statutory authority amenable to the writ jurisdiction of this Court.

A writ petition against a Private Limited Company, which is not amenable to the writ jurisdiction of this Court, is not maintainable.

Accordingly, finding the petition against the respondents - a Private Limited Company, to be not maintainable, this writ petition is dismissed.
