22. 08-2013 The Petitioners seek quashing of the entire proceeding including the order of cognizance dated 19.11.2007 passed by the S.D.J.M., Jehanabad in Complaint case No.859 of 2007 (Trial No.1835 of 2007). The case of the Complainant is that she was married with the Petitioner No.1 in the year 1994 but the accused persons started to demand extra dowry, on account of which she was tortured and thrown out of her matrimonial home. It has been submitted on behalf of the Petitioners that the Complainant was never married to the Petitioner No.1, who in fact is married to Petitioner No.2, for this reason when repeated notices were sent to her by this Court she did not respond to them. In view of such Patna High Court Cr.Misc. No.54927 of 2007 dt.22-08-2013 2 false allegation the prosecution may be set aside. Considering such aspect of the matter, the application is allowed and the entire proceeding including the order dated 19.11.2007 passed by the S.D.J.M., Jehanabad in Complaint case No.859 of 2007 (Trial No.1835 of 2007) is hereby set aside.
