Petitioner has been made accused for the offence under Sections 302/120B/34 of the Indian Penal Code, 27 of the Arms Act and Section 17 of the C.L.A. Act, in connection with Rail (Hatia) P.S. Case No.14 of 2009, corresponding to G.R. No.62 of 2009. (S.T. No.42 of 2013) The case relates to murder of a police constable, who was going on a train. It is alleged that two unknown persons came and committed the murder and the case was instituted against unknown. Learned Counsel for the petitioner submitted that petitioner has been falsely implicated in this case and has prayed for bail. Learned counsel for the State has opposed the prayer for bail and from the case diary it has been pointed out that two eye witnesses of the occurrence have stated that it was the petitioner, who had fired pistol upon the deceased, causing his death. In the facts and circumstances of the case, I am not inclined to release the petitioner Karma Oraon on bail. Accordingly, prayer for bail stands dismissed. (H. C. Mishra, J) R.Kumar
