05. 29.08.2013 By way of instant interlocutory application petitioner has now sought to challenge the order dated 20.6.2013 by which the promotion granted to him to the post of Block Education Extension Officer has been cancelled by the Director, Primary Education cum Joint Secretary, Directorate of Primary Education, Department of Human Resource and Development, Government of Jharkhand. In the main writ application, petitioner has approached this Court against the order dated 25.8.2012 which is annexed as Annexure-2 to the main writ application whereby recommendation was made by the Director, Primary Education, Ranchi for cancellation of promotion of the petitioner. In view of the subsequent development, having taken place during the pendency of the writ application, whereby petitioner's promotion to the post of Block Eduction Extension Officer has been cancelled , the prayer made in the instant I.A. deserves to be allowed in order to avoid multiplicity of the proceeding as also it relates to the main cause of action. Accordingly, I.A. No. 4305 of 2013 stands disposed of. W.P.(S). No. 5434 of 2012 Petitioner is permitted to file an amended writ application incorporating the proposed amendments in the main writ application within a period of 2 weeks. The respondents are at liberty to file response to the amended writ application as also to the averments made in the supplementary affidavit filed on 23.7.2013 within a period of 3 weeks, thereafter.
