Learned counsel for the petitioner after seeking instruction from his client submitted that petitioner has already submitted his joining on the subsequent transferred place of posting at Bararee Colliery from Lodna Colliery under the notification dated 10.10.2012. The aforesaid notification of his transfer to Bararee Colliery is under challenge in W.P.S. No. 350 of 2013. Petitioner had earlier preferred writ petition being W.P.S. No. 6994 of 2012 challenging the earlier order of transfer dated 30.10.2012 from Joyrampur colliery to Lodna Colliery. Since, the petitioner has already submitted his joining at Bararee Colliery upon the subsequent notification dated 10.10.2012, therefore the cause of action raised by the petitioner in the instant writ petitions have now been rendered infructuous.
