Thepetitionerintheinstantcase,claimsherselftobethewidowofthe deceasedemployee,BholaSingh,whoissaidtohavediedinthecapacityof Shodhak in harness on 28th January, 2012, while working under the RespondentsM.A.D.A.asperthedeathcertificatecontainedatAnnexure1. Thegrievanceofthepetitioneristhatthedeathcumretiraldues ofthedeceasedemployeesuchasprovidentfundwithcontributorybenefits, gratuity,leaveencashment,groupinsurance,dearnessallowances,benefitsof 6th Pay Revision, difference payments of 1stTime Bound Promotion & 2nd TimeBoundPromotion,benefitsofA.C.P.aswellasanyotherlegitimatedues, have not been paid to her despite representations made before the RespondentsM.A.D.AvideAnnexure2dated28thDecember,2012 LearnedcounselfortheRespondentsM.A.D.Asubmitsthatifthe petitioner approaches the competent authority i.e. Managing Director, M.A.D.A.,Dhanbad withfreshrepresentation,hergrievancesshallbelooked intoinaccordancewithlawandtheSchemeframedforretiredemployeesof M.A.D.A. In such circumstances, since the matter relates to payment of deathcumretiraldues,atthisstage,withoutcommentinganythingonmerits upontheclaimofthepetitioner,thewritpetitionisdisposedofwithlibertyto the petitioner to approach the Managing Director, M.A.D.A, Dhanbad with freshrepresentationforredressalofheraforesaidgrievancessupportedwithall facts and documents within a period of 3 weeks. On receipt of such representation,theManagingDirector,M.A.D.A,Dhanbadshallconsiderthe sameinaccordancewithlawandafterproperverificationoftheservicerecords ofthedeceasedemployee,passareasonedandspeakingorderwithinaperiod of12weeksthereafter,whichshallalsobecommunicatedtothepetitioner. Needlesstosaythatifanyoftheclaimsmadebythepetitionerarefoundtobe 2. genuine and legally admissible, the payments in lieu thereof shall also be disbursedwithstatutoryinterestifany,inaccordancewithlawandScheme framedforretiredemployeesofM.A.D.A.
