2. The petitioner is an accused in O.R.No.142/1998 of Adoor Excise Range. The case is now pending as L.P.No.2/2003 in S.C.No.116/2000 on the file of the Additional Sessions Court, Fast Track No.1, Pathanamthitta. The offence alleged is under Section 55(b) of the Kerala Abkari Act.

3. A report was called for by this Court and going by the report submitted by the Additional District and Sessions Judge, steps were taken under Sections 82 and 83 of the Code of Criminal Procedure and now the case is pending as L.P.No.2/2003 and is posted for return of warrant to 25/03/2013.

4. Learned counsel for the petitioner submitted that the petitioner will surrender before the court and will file an application for bail and the same may be directed to be considered on the same date of surrender.

5. The petitioner will surrender before the court within a period of one week and if an application for bail is filed, the same will be considered preferably on the same date of surrender itself.
