The petitioner, who is the 3rd accused in C.C.No.343/2009 on the file of the Judicial First Class Magistrate Court, Nilambur, is seeking for a direction to consider the bail application on the date of his surrender itself and to grant him bail.

2. It is stated in the Crl.M.C that the petitioner had appeared in court and was enlarged on bail. While so, he got an employment in Saudi Arabia and he accepted the job and went to Saudi Arabia in January 2010. Since the employer did not permit him to leave, he could not come and face the trial which resulted in cancellation of the bond executed by the petitioner as well as issuance of notice to the sureties. He has now returned to India and is ready to surrender before the learned Magistrate. The petitioner will surrender before the court below within a period of ten days from today and if an application for bail is Crl.M.C.No.742/2013 2 filed, the same will be considered on the same day of surrender and appropriate conditions will be fixed.
