Counselappearingforthepetitionersubmittedthatthe respondentState is not giving extra time or additional time to appearintheexaminationtothedisabledpersons.Thosewhoare disabled, they should be given extra time or additional time to appear in the examination whether it is school examination, collegeexaminationorexaminationconductedbyanyeducational institutionsoritmaybebypublicservicecommissionorforany competitive examination as well as the examinations which are conductedbytheState.

2. The counsel appearing for the petitioner has pointed outseveralinstancesinwhichextratimeoradditionaltimeisgiven to the disabled persons to appear in the examination, in comparisonwiththosewhoarenotdisabledpersons.

It is submitted by the counsel for the state that in pursuance of the guidelines, given by the Government of India, Ministry of Social Justice and Empowerment, Department of DisabilitiesAffairs,NewDelhi,forconductingwrittenexamination forpersonswithdisabilitiesdated26th February,2013inClause no.XI,ithasbeenprovidedbytheCentralGovernmenttogive 2 extratimeoradditionaltimetothepersonswhoaremakinguseof scribe/reader/labassistantintheexamination. Theseguidelines havebeengiventotheSecretary,DepartmentofSocialWelfare, Government of Jharkhand. Counsel appearing for the State is unabletopointoutwhethertheStateofJharkhandisgivingthis extratimeoradditionaltimetoappearinthewrittenexamination tothedisabledstudentswhoareappearingintheschool/college examinations or in competitive examinations conducted by the Boards appointed by the State of Jharkhand and to get this instruction,heisseekingtime.

4. ItappearsthatthereisaguidelinegivenbytheCentral Governmentasstatedhereinabovetogivecompensatorytimeto the disabled persons/students who are appearing in the written examinations. Looking to the circular we hereby direct the petitionertojoin: (i) RanchiUniversity(noticetobeservedthrough theRegistrarwhereofasapartyrespondentno. 3), (ii) Vinoba Bhave University, Hazaribagh (notice to be served through the Registrar whereof at Hazaribaghaspartyrespondentno.4), (iii) Sidhu Kanhu University, Dumka (notice to be servedthroughtheRegistrarwhereofatDumka aspartyrespondentno.5), (iv) NilamberPitamberUniversity,Daltonganj(notice to be served through the Registrar whereof at Daltonganjaspartyrespondentno.6), (v) KolhanUniversity,Chaibasa(noticetobeserved through the Registrar whereof at Chaibasa as partyrespondentno.7), (vi) Jharkhand High Court, Ranchi (notice to be servedthroughtheRegistrarGeneralwhereofat Ranchiaspartyrespondentno.8)”

5. Issuenoticetothenewlyjoinedparties.

6. Mr. Anoop Kumar Mehta waives service of notice on behalfofRanchiUniversityi.e.respondentno.3andwedirectthe counselforthepetitionertosupplycopyofthepetitionalongwith annexures to the counsel Mr. Anoop Kumar Mehta who is appearingforRanchiUniversity.

7. Mr.PramodKumarChoudharywaivesserviceofnotice onbehalfofSidhuKanhuUniversityi.e.respondentno.5andwe directthecounselforthepetitionertosupplycopyofthepetition alongwithannexurestothecounselMr.PramodKumarChoudhary whoisappearingforSidhuKanhuUniversity.
