JUSTICE JAYA ROY For the Petitioner : Mr. Rakesh Kumar Sinha, Advocate For the State : A. P. P. 02/24.07.2013 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is an accused in a case for the offence registered under Sections 414, 419, 420, 467, 468, 469, 471, 120(B) of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner is the student of Baliapur Institute of Technology at Dhanbad and his date of birth is 05.05.1995, he has just completed 18 years of age. It is also submitted that the name of the petitioner has come only on the confessional statement of the co-accused, who has stated about the petitioner that the petitioner is his closed friend and also participated in the theft of the motorcycle. Learned counsel for the State has opposed but she has not disputed the aforesaid contentions made by the counsel for the petitioner and she has also accepted that except the confessional statement of the co-accused, nothing has come against the petitioner. Considering the fact that name of the petitioner has come only on the confessional statement of the co-accused, the petitioner, above named, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Dhanbad in connection with Dhanbad P.S. Case No. 609 of 2013 corresponding to G.R. No. 2400 of 2013, subject to the condition that the petitioner will remain physically present before the trial Court once in a month on the date fixed for trial till the conclusion of the trial and one of the bailors will be local resident having immovable property within the jurisdiction of the District concern.
