Heard learned counsel for the petitioner and the learned counsel for the State. The petitioner has been made accused in connection with Sadar P.S. Case No. 314 of 2012, corresponding to G.R. No. 6001 of 2012, for the offence under Sections 406, 420 and 120B of the Indian Penal Code. From the F.I.R. it appears that a consignment was sent on a truck which never reached its destination. The petitioner has been made accused in this case being the owner of the truck and the impugned order shows that the empty truck was recovered from the house of the petitioner. Admittedly, the petitioner is the owner of the truck and thereafter there is only the confessional statement of the petitioner. In the facts of this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, Birendra Singh, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amitesh Lal, learned Judicial Magistrate, 1st Class, Ranchi, or his successor, in connection with, Sadar P.S. Case No. 314 of 2012, corresponding to G.R. No. 6001 of 2012. (H.C.Mishra, J.) D.S.
