Dubey,APP 3/30.07.2013: This application has been filed for modification of order dated 28.09.2012 passed in B.A. No. 6945 of 2012 ( Annexure-1). It appears that by the said order, petitioner has been granted regular bail subject to the condition that petitioner shall produce a certificate issued by a Nationalized Bank to show that he has fixed deposited Rs. 50,000/- in the name of his son for 10 years. It is submitted that the petitioner is in custody and informant who is ex-wife of petitioner, has not cooperated and because of that petitioner could not furnish the fixed deposit certificate and therefore he is still in custody. Accordingly, it is submitted that the petitioner may be enlarged on provisional bail so that he can deposit the aforesaid amount as per the direction of this Court and furnish the certificate in the court below. Considering the aforesaid facts and circumstance, I allow this application and modify the order dated 28.09.2012 passed in BA No. 6945 of 2012 in the following manner:- The court below shall grant provisional bail to the petitioner for one month, on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with Dhurwa ( Tupudana) P.S. Case No. 46 of 2012 ( G.R. No. 1166 of 2012). Petitioner is directed to deposit Rs. 50,000/- in the name of his son born out of wed lock of petitioner and informant, for 10 years and produce certificate in the court below regarding the same. If the aforesaid certificate is filed in the court below, the court below will confirm the bail of the petitioner. Informant is directed to cooperate with the petitioner in getting the aforesaid amount fixed deposited in the name of her son. ( Prashant Kumar,J.) Sharda/-
