The simple grievance of the petitioner in the present writ application is that a Bank Draft of Rs. 58,464/- which was submitted by the husband of the petitioner for lifting wheat and rice for public distribution shop in the year 2007-08 is not being returned to her in spite of the fact that the said material could not be lifted as her husband died on 17th February 2008.
3. According to the petitioner, vide Annexure-2, the Sub Divisional Officer, Godda has advised the son of the present petitioner to approach the District Manager, State Food Corporation, Sahibganj for return of the aforesaid draft.

Having heard counsel for the parties, this Court without getting into the merits of the case, is inclined to dispose of the writ petition with liberty to the petitioner to approach the Respondent No. 6 - The District Manager, Department of State Food Limited, Sahibganj with a representation seeking refund of the said amount claimed to be deposited by her husband, with all supporting facts and documents. On receipt of such representation, the respondent no. 6 shall consider the same in accordance with law and pass necessary order within a period of six weeks thereafter. If the petitioner is found entitled to such refund, the same may be made upon proper verification of the identity of the petitioner that she is the wife of the deceased, within two weeks thereafter.
