Anticipatory bail application filed by Bimal Kumar Tudu is moved by Sri Rajiv Sharma, learned counsel for the petitioner and opposed by Sri G.S. Prasad, Addl.P.P. for the State. It is alleged that while petitioner was taking 12.50 quintals of rice for selling in black market, same was seized by villagers and kept in Saksharta Bhawan. However, from perusal of case diary, specially at paragraph no.35, I find that no discrepancies and irregularities found in the shop of the petitioner. Considering the aforesaid fact and circumstance, I allow this application and direct the petitioner, named above, to surrender in the court below by 05.08.2013. If petitioner surrenders by that time, the court below is directed to enlarge the petitioner, named above, on bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dumka in connection with Masalia(Tongra) P.S. case no.09/13, corresponding to G.R.No.170/13, subject to the condition as laid down under Section 438(2) of the Cr.
