West Bengal Luxury Tax Act, 1994 Complete Act

..... (i) "stockist" means a person who has, in customary course of business, in his possession of, or control over, a stock of luxuries, whether manufactured, made or processed by him in West Bengal, or brought by him into West Bengal, either on his own account or on account of others, from any place outside West Bengal, for stocking, vending, supplying or distributing such luxuries in West Bengal; (j) "Taxation Tribunal" means the West Bengal Taxation Tribunal constituted uner section 3 of the West Bengal Taxation Tribunal Act, 1987; (k)22.Clause (k) subs. by W.B. Act 11 of 1995, which was earlier as under: '(k)"Tribunal" means the West Bengal Commercial Taxes Tribunal constituted under section 3B of the Bengal Finance (Sales Tax) Act, 1941:'. "Tribunal" means the West Bengal Commercial Taxes Appellate and Revisional Board constituted under section 6 of the West Bengal Sales Tax Act, 1994; (I) "turnover of stock of luxuries", in relation to a stockist in respect of any prescribed period or part thereof, means the aggregate of the values of stock of luxuries; (m) "value of stock of luxuries" means, (i) in respect of any stockist, being a manufacturer of any of the luxuries,.....

.....being in force, no civil court shall have any jurisdiction to entertain any petition calling in question the validity of any election under this Act. Section 3 Amendment of section 49 of the Act After sub-section (4) of section 49 of the principal Act, the following sub-section shall be inserted : "(5) Notwithstanding anything contained in this Act or in any agreement, instrument or undertaking, having effect by virtue of this Act, or any commitment or concession made by the Board or by any judgement, decree or order of any court or by any order of any other authority prior to the commencement of the Electricity (Supply) (West Bengal Amendment) Act, 1994, it shall be lawful for the Board to frame uniform tariff for the supply of electricity under sub-section (1) or to revise such tariff from time to time, as the case may be, for such supply: Provided that in framing the uniform tariff under sub-section (1) or in revising such tariff, the Board shall be guided by the provisions of section 59 and sub-section (2), sub-section (3) and sub-section (4) of this section : Provided further that every such agreement, instrument or undertaking, or commitment or concession, shall, in so far as it is inconsistent with the first.....
