WEST BENGAL LAND (REQUISITION AND ACQUISITION) RE-ENACTING ACT, 1977 WEST BENGAL LAND (REQUISITION AND ACQUISITION) RE-ENACTING ACT, 1977 15 of 1977 An Act to re-enact the West Bengal Land (Requisition and Acquisition) Act, 1948. WHEREAS it is expedient to re-enact the West Bengal Land(Requisition and Acquisition) Act, 1948, for the purposes and in the manner hereinafter appearing; It is hereby enacted as follows :- Section 1 Short title and commencement (1) This Act may be called the West Bengal Land (Requisition and Acquisition) Re-enacting Act, 1977. (2) It shall be deemed to have come into force on the 1st day of April, 1977. Section 2 Re enactment of West Ben. Act 2 of 1948 The West Bengal Land (Requisition and Acquisition)Act, 1948, as in force on the 31st day of March, 1977 (hereinafter referred to as the said Act,) is hereby re-enacted subject to the modification that for sub-section (4) of section 1, the following sub-section shall be substituted, namely: "(4) It shall remain in force until the 31st day of March, 1979.". Section 2 Application of the Act The Limitation Act, 1963 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended in the manner hereinafter provided. Section 3 Amendment of the Schedule to Act 36 of 1963 In the FIRST DIVISION of the Schedule to the said Act, under the heading "PART IX. SUITS RELATING TO MISCELLANEOUS MATTERS", in the entry in the first column against article 112, after the words "Jammu and Kashmir", the following words shall be, and shall be deemed always to have been, added, namely : "or a Government company owned wholly either by the Central Government or by the State Government or jointly by the Central and the State Governments.". Section 4 Repeal and savings (1) The Limitation (West Bengal Amendment) Ordinance, 1977, is hereby repealed. (2) Anything done or any action taken under the said Act as amended by the Limitation (West Bengal Amendment) Ordinance, 1977, shall be deemed to have been validly done or taken under the said Act as amended by this Act as.....

Explanation For the purpose of this section, (a) "company" means any body corporate and includes a firm or other association of individuals; and (b) "director", in relation to a firm, means a partner in the firm. Section 8 Indemnity No suit, prosecution or other legal proceeding shall lie against the Director for anything which is in good faith done or intended to be done under this Act. Section 9 Power to make rules The State Government may, by notification in the Official Gazette, make rules for carrying out the purpose of this Act. Section 10 Repeal and savings (1) The West Bengal Nationalised Text-Books Ordinance, 1976, is hereby repealed. (2) Anything done or any action taken under the West Bengal Nationalised Text-Books Ordinance, 1976, shall be deemed to have been validly done or taken under this Act as if this Act had commenced on the 30th day of December, 1976.
