West Bengal Agricultural Produce Marketing (Regulation) Act, 1972 Complete Act

.....It has merely sought to regulate the activities of the users of Markets recognised as such. Its provisions are liable to be by-passed and are in fact being by-passed by the operators of wholesale trading carried on in 'rnandis' and ganjas outside the market precincts. Unless the 'market yard', the 'market proper': and the 'market area' are adequately defined and brought within the ambit of regulation, a large part of the buying and selling of agricultural produce may evade the operation of the Act. The Act oriented towards controlling the owners of markets; the primary duty of running the markets is Imposed upon the owners of the market: the market committee or the State Government may not intervene except in the event of formal failure on the part of the owners. If the present owners abide by the fair rents, undertake to check specified malpractices, provide for certain sanitary arrangements and maintain the markets as they are. such markets have to be left in their charge. The owners do not have any obligation to develop the markets and will have no incentive nor will they have resources enough for Investment for new development. .....with the production, distribution or supply of any essential commodity or maintenance, of any essential service, any sewage works, mine or factory ; (e) any prohibited place as defined in sub-section (7) of section 2 of the Official Secrets Act, 1923. (2) The' provisions of sub-section (1) shall apply in relation to any omission on the part of a person to do anything which he is under a duty imposed on him by any law or an order of any competent authority to do, as they apply to the doing of any act by a person. (3) If any person contravenes any of the provisions of this section, he shall be punishable with imprisonment for a term which may extend to seven years, or with fine, or with both. Section 9 Penalty for subversive acts If any person commits any subversive act, he shall be punishable with imprisonment for a term which may extend to ten years, or with fine, or with both. .....Criminal Procedure, 1898, in its application to West Bengal for the purpose and in the manner hereinafter appearing; It is hereby enacted as follows: Section 1 Short title This Act may be called the Code of Criminal Procedure (West Bengal Amendment) Act, 1972. Section 2 Application of the Act The Code of Criminal Procedure, 1898 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended for the purpose and in the manner hereinafter pro- vided. Section 3 Amendment of section 251A of Act 5 of 1898 In section 251A of the said Act, in sub-section (6), after the word "witnesses", the following words shall be added, namely : "and shall summon the witnesses and call for the documents or things, specified in any application made on behalf of the prosecution unless, for reasons to be recorded, he deems it unnecessary to summon or call for all or any of them.". Section 9 Power to make rules The State Government may make rules for carrying out the purposes of his Act.
